Conditions of Use

Use of the Sportsman's Finest website constitutes agreement to our terms of use. We encourage you to review the following information carefully. 

Affidavit of Customer

• I am not an unlawful user or addicted to any controlled substance.
• By selling or delivering ammunition to me, Sportsman's Finest is not violating any state or local law or ordinance.
• I have never been and I am not expected to be convicted in any court of a misdemeanor crime of domestic violence.
• I am not under indictment for and have never been convicted in any court of a crime punishable by imprisonment for over one year.
• I am not a fugitive from justice.
• I am currently not subject to a restraining order of any kind.
• I have not been adjudicated as a mental defective and I have not been committed to any mental institution.
• I am not an illegal or unlawful alien.
• I have never been and I am not expected to be discharged from the Armed Forces under dishonorable conditions.
• I am not currently less than twenty-one (21) years old.
• I have not renounced my U.S. citizenship.

Applicable Law

Sportsman's Finest is a licensed business in the State of Texas. Sportsman's Finest complies with all applicable State and Federal laws. All products and persons associated with Sportsman's Finest comply with State and Federal restrictions. 

By visiting www.sportsmansfinest.com, you agree that the laws of the state of Texas, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Sportsman's Finest.

Changes In Policy

Sportsman's Finest reserves the right to modify, alter, delete and update these policies at any time we see fit. Such alterations do not nullify our rights if infringements or breaches occurred under a previous version of these conditions.

Prohibited Shipping Addresses

Sportsman's Finest does not ship to APO or PO Boxes.

ALL FIREARMS MUST BE SHIPPED TO A VALID FEDERAL FIREARMS DEALER (FFL) 

Sportsman's Finest complies with all federal, state, and local laws that restrict the sale and transfer of firearms, magazine feeding devices, ammo, and other prohibited products.  

It is YOUR responsibility to know your local and state laws which may prohibit or restrict your ability to purchase certain products that Sportsman's Finest offers for sale.

Waiver & Export Restrictions – 2022

The Undersigned Agrees To The Following

I must be a U.S. Citizen or Permanent Resident (Green Card Holder) to purchase ITAR controlled items.

I understand that the products listed on the attached order may be subject to one or more of the export control laws and regulations of the U.S. Government and that they fall under the control jurisdiction of either the Department of State’s International Traffic in Arms Regulations (ITAR) or the Department of Commerce’s Export Administration Regulations (EAR), or the U.S. Bureau of Industry & Security (BIS).

I understand that it is unlawful to take outside the USA, export, or attempt to export or otherwise transfer or sell any hardware or technical data or furnish any service to any foreign person, whether abroad or in the United States (U.S.), for which a license or written approval of the U.S. Government is required, without first obtaining the required license or written approval from the department of the U.S. Government having jurisdiction.

I understand that, in ITAR (§ 120.16), a foreign person means any natural person who is not a lawful permanent resident as defined by 8 U.S.C. 1101(a)(20) or who is not a protected individual as defined by 8 U.S.C. 1324b(a)(3). It also means any foreign corporation, business association, partnership, trust, society, or any other entity or group that is not incorporated or organized to do business in the U.S., as well as international organizations, foreign governments and any agency or subdivision of foreign governments (e.g., diplomatic missions). History: 59 FR 25811, May 18, 1994; 71 FR 20534, April 21, 2006.

I understand that I am responsible for compliance with any, and all U.S. Government export controls and regulations and that, if I violate them, it could result upon conviction in severe criminal and civil penalties (including substantial fines, imprisonment, seizure of controlled products, and technical data, and/or suspension/removal of export privileges).

I understand that these items CANNOT BE EXPORTED, provided to foreign persons in the U.S. (Including Foreign Embassies in the U.S.A.), or sold domestically for export by a third party (including U.S. Government agencies).If/when I resell these items, I will advise the buyer of their duty to comply with U.S. export control regulations or face the possibility of severe criminal and civil fines including imprisonment if convicted.

If/when I resell these items, I will obtain and retain record of the sale.

If/when I resell these items, I will inform my buyers that if these items are lost, stolen or destroyed, they must report to me this fact and provide the date of the incident as well as the associated serial number of the item.

ITAR Compliance Acknowledgement

Export of the commodities described herein is strictly prohibited without a valid export license issued by the U.S. Department of State Office of Defense Trade Controls prescribed in the International Traffic in Arms Regulation (ITAR), Title 22 Code of Federal Regulation, Parts 120-130. 

Refunds And Exchanges

All sales are final on ammunition, firearms, sale merchandise and gift cards. No returns, exchanges, refunds, or store credit.

We accept returns or exchanges if the item you purchased is defective. If you receive a defective item, please contact us via email at [email protected]  or phone call (512-263-1888) with details of the product and the defect. Further instructions will be provided if the item is to be returned and/or exchanged. Returns of defective or damaged merchandise are governed by the policies of the manufacturer and may be subject to a service fee charged by the manufacturer and/or Sportsman's Finest.

Accepted returns with a receipt within 30 days of purchase will be refunded exchanged, or issued a store credit for the purchase price of the item. Returns with a receipt beyond 30 days, but before 60 days from date of purchase, will be exchanged or issued a store credit for the purchase price of the item. No refunds on merchandise beyond 30 days of purchase. No returns, exchanges, refunds or store credit without a receipt or beyond 60 days from date of purchase.

Returned items must be unused and unaltered, with their original packaging and tags. Upon receipt of the returned item, we will fully examine it and notify you via e-mail and/or phone call, within a reasonable period of time, whether you are entitled to a refund or a replacement as a result of the defect. If you are entitled to a replacement or refund, we will replace the product or refund the purchase price, using the original method of payment.

Refunds do not include any shipping and handling charges shown on the packaging slip or invoice. Shipping charges for all returns must be prepaid and insured by you. You are responsible for any loss or damage to hardware during shipment. We do not guarantee that we will receive your returned item. Shipping and handling charges are not refundable. Any amounts refunded will not include the cost of shipping.

Canceled Orders

All canceled orders are subject to a 20% restocking fee so please review carefully before placing your order.

Ammunition

Under the Gun Control Act (GCA), shotguns and rifles, and ammunition for shotguns or rifles may be sold only to individuals 18 years of age or older.  All firearms other than shotguns and rifles, and all ammunition other than ammunition for shotguns or rifles may be sold only to individuals 21 years of age or older. However, it is our company policy that ammunition buyer must be at least 21 years of age to purchase ammunition.

We do NOT sell ammunition to New York, California, Oregon, Washington, Maryland, New Jersey, Massachusetts, Connecticut, Rhode Island, Delaware, Hawaii,  Illinois, and Minnesota. No exceptions.

As a sender, we require adult signature on receipt of ammunition parcel.

Ammunition buyer must be at least 21 years of age to purchase ammunition, and never have been convicted of a felony or adjudicated as mentally defective or been committed to a mental institution. All state, local and federal laws apply. By placing an order on this website you certify that you can legally purchase, receive and own ammunition. Please do not attempt purchase if you are prohibited from buying the item in your area.

The Gun Control Act (GCA), codified at 18 U.S.C. 922(g), makes it unlawful for certain categories of persons to ship, transport, receive, or possess ammunition, to include any person:

• Convicted in any court of a crime punishable by imprisonment for a term exceeding one year;
• Who is a fugitive from justice;
• Who is an unlawful user of or addicted to any controlled substance (as defined in section 102 of the controlled substances act, codified at 21 u.s.c. § 802);
• Who has been adjudicated as a mental defective or has been committed to any mental institution;
• Who is an illegal alien or, except as provided in 18 u.s.c. 922(y)(2), has been admitted to the u.s. under a nonimmigrant visa;
• Who has been discharged from the armed forces under dishonorable conditions;
• Who has renounced his or her united states citizenship;
• Who is subject to a court order restraining the person from harassing, stalking, or threatening an intimate partner or child of the intimate partner; or
• Who has been convicted of a misdemeanor crime of domestic violence

Ammunition Returns & Canceled Orders

All sales are final on ammunition, we cannot take ammunition in return that has been in the hands of the public. Exceptions are made for defective merchandise only. In the event of you receiving a product that is defective from the manufacturer, we will either have the return made to the manufacturer for exchange or to us for an exchange or refund. Orders that have been shipped cannot be canceled. Only orders that are still awaiting shipment can be canceled. 

Indemnification and Agreement to Defend

I fully agree that if any of my representations when making purchases under the Terms of Sale are incorrect or if I fail to comply with these Terms of Sale, then I will indemnify, defend, save harmless, and release sportsmansfinest.com and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from my purchase from Sportsman's Finest.

I fully agree that by placing my order, I release Sportsman's Finest from any and all liability arising from or related to the products I purchased from Sportsman's Finest, including (but not limited to) my or anyone else use of the product, my or anyone else’s storage of the product, and my or anyone else’s handling or transportation of the product, and I agree to indemnify, defend, save harmless, and release Sportsman's Finest and its owners, agents, officers, and employees against any civil liability or criminal prosecution resulting from the products I purchased from Sportsman's Finest.

Class Action Waiver

You expressly agree that any dispute resolution proceedings, including but not limited to, litigation, arbitration, and mediation, will be conducted only on an individual basis and not in a class, consolidated, or representative action. By making this express agreement, you acknowledge and affirm that this is a knowing, voluntary, and permanent waiver of any right to bring federal, state, or local claims as any part of, or on behalf of, any class or any other individuals, before a court or other tribunal.

Trademarks

Sportsman's Finest and other marks indicated on our site are trademarks owned exclusively by Sportsman's Finest. The use of these trademarks and trade dress is prohibited if used in connection with the sale of any product that is not Sportsman's Finest, in any manner that seeks to disparages or discredit Sportsman's Finest or in any manner that may cause confusion among our customers.

All content on this website is the exclusive property of Sportsman's Finest. Said content includes text, graphics, logos, icons, images, audio and video clips, digital downloads, and software. Our content is protected by United States and international copyright laws and we reserve all rights contained therein. In case of dispute or infringement, we will rigorously defend our rights to this material.
